Criminal Defense
Got arrested or facing arrest? Considering retaining a criminal defense attorney? Learn how to select the most qualified attorney reasonably possible. Learn how attorney fees are computed and negotiated. Not all criminal defense attorneys practice the same type of criminal law nor do they necessarily have the same skill set. For example, a drunk driving defense lawyer rarely practices federal criminal defense and mostly deals with misdemeanor type cases. On the other hand, if you are being charged with a federal crime, such as securities fraud, you will need to find a highly experienced federal crimes attorney. Criminal law and its defense involve the government prosecution of an individual for an act that is classified by federal or local law as a crime. Criminal cases are tried through a state prosecutor or district attorney who initiates the criminal filings of such cases. Individuals who are convicted of a crime may be incarcerated, fined, or a combination of both. Criminal violations include both felonies and misdemeanors. Felonies are more serious criminal offenses such as murder or rape. Misdemeanors are less serious criminal offenses such as petty theft. Felonies are punishable most of the time for a minimum of one year in prison. Misdemeanors are punishable for less than one year in prison. Most crimes consist of two key elements: a physical act and the criminal intent to actually commit that act. The government through their criminal prosecutors must prove all elements of the crime to gain a conviction. In addition, the criminal law prosecutor must convince a jury or judge ‘beyond a reasonable doubt’ of all facts needed to prove the guilt of the crime charged.
