A tort is a civil wrong for which the law provides a remedy in the form of damages. To recover compensation under the tort of negligence, the plaintiff needs to prove that a duty that was owed to him or her, that the duty was breached, and that the breach directly caused damage. Damages can be assessed for personal injury or economic losses.

Recoverable damages include the cost of medical and hospital bills, loss of earnings, property damage, pain and suffering, emotional distress and any other loss which can be proven. In order to be compensated for your damages, the court must be able to ascertain the value of the loss. If your damage claims are too speculative and would require guessing by the court or jury, you may not recover for them. If you have been damaged by someone else's torturous conduct, you should consult with an attorney who can help determine the value of your damages and the chance of recovery.
