personal injury lawyer should act in a way that upholds the highest
standards of professionalism in representing a client's interests,
while maintaining the administration of justice. Standards of conduct
for lawyers are determined both ethically and legally. Standards
seek to ensure prompt, adequate, and lawful assistance to clients.
Various codes set standards for lawyers. The Supreme Court has adopted
a Code of Professional Responsibility. The American Bar Association
has its Canons of Professional Ethics that govern the behavior of
its members. In addition, individual state Supreme Courts and legislatures
may have their own codes of conduct. The American Bar Association
began in 1980 to develop Model Rules of Professional Conduct. Some
of the responsibilities spelled out in the Rules include the following:
the personal injury lawyer is an officer of the legal system, a
representative of clients, a public citizen; he or she should safeguard
the client's interest when negotiating, while still showing fairness
to others; and he or she should act competently, promptly and diligently.
