Remember, if you are in a non-judicial foreclosure state, the law requires that the trustee comply with strict procedural guidelines and requirements or the sale could be later held to be invalid. In this regard, you might be able to delay the sale of your home by a few more weeks if you determine there are material inaccuracies in the document or a defect in the notice requirements and you promptly communicate the same to the trustee in writing before the date set for sale of the property.

Examples of material inaccuracies in the Notice of Trustee Sale include:

Failure of the trustee to accurately identify the specific location and time where the auction will be held.

Failure to provide an accurate legal description of your property in the notice - but be aware that in many states an actual street address need not be included if the document otherwise contains sufficient information to identify the property.

Failure to provide timely notice of the sale by having the date of sale not more then twenty calendar days after issuance of the trustee Notice of Sale to the homeowner. Be advised that the notice requirements might be different in your state so be sure to seek the advise of an experience real estate lawyer in your area.
