What if my spouse gives away marital property?
In family law, you probably have the right to have the gift returned - if you can find (and, perhaps, sue) the person who received it. You may also have the right to receive more in a divorce to compensate you for the loss of the property. You also may be able to get a court order preventing your spouse from giving away any more property. If he or she violates the order, it could be treated as contempt of court - which could result in jail time. Check with a family law attorney in your area.
