Funerals and disputes

If you have a dispute with a funeral provider that the two of you don't seem to able to sort out amicably, you have several options. You could contact your state's Department of Health, which may license funeral providers. In some states, it's the Department of Consumer Affairs that oversees the funeral business. The Better Business Bureau might also offer assistance: www.bbb.org.

The Funeral Service Consumer Assistance Program (FSCAP) is a non-profit consumer organization that will, among other services, assist consumers to resolve such problems. The FSCAP website is: http://www.fsef.org/consumerassistance, or you can phone: 1-800-662-7666.

If these agencies aren't able to help you resolve the issue, you may file a complaint with the FTC, but you should be aware that the Commission will not step in to seek resolution to an individual issue; that is not its role. The FTC has the option of taking action against a company where it finds a pattern of violations. To lodge a complaint, you can go to the website (www.ftc.gov), or phone 1-877-382-4357.

If you do find yourself involved in a dispute, take a measured approach. You might be well advised to talk to a friend whose judgment you respect; your emotional state could be amplifying a relatively small problem. An unbiased perspective may be constructive. Contacting a national regulatory agency, such as the Federal Trade Commission, is a serious move and could have a profound impact on the funeral home. Be sure that you make the distinction between a disagreement or misunderstanding and an allegation of wrongdoing.
